2) Scope
These Terms apply to all purchases of, and access to, Buziness Digital’s online guide and related services (“Service”). By purchasing or using the Service, you agree to these Terms.
Your use is also subject to our Privacy Policy and Refund & Withdrawal Policy (each published on our website). If local mandatory consumer laws apply to you, they take precedence over conflicting parts of these Terms.
3) The product
We provide digital content in the form of an online guide delivered via web-based access. The guide is hosted on Payhip and is accessed online with an internet connection after payment; it is not provided as a downloadable file. No physical goods are shipped.
Checkout, payment collection, and delivery of the guide are handled through our checkout and delivery partner Payhip (Payhip Limited, 85 Great Portland Street, First Floor, London, United Kingdom, W1W 7LT, company no. 08386910). Buziness Digital remains the seller and your contracting party for the purchase. Payhip provides the checkout page, order processing, and delivery infrastructure on our behalf and is not a party to the purchase contract, except with respect to VAT as described in Section 7. Your use of the Payhip checkout is also subject to Payhip's own Privacy Policy.
4) Eligibility
You must be legally able to enter into a contract where you live. If you use the Service on behalf of a company, you confirm you are authorized to bind that company.
5) Account and access
- After successful payment via the Payhip checkout, you receive an order confirmation email containing a direct access link to the online guide.
- You may optionally create a free Payhip customer account to view all your Payhip purchases (including the guide) in one place. This account is created and managed with Payhip, not with us directly, and you are responsible for keeping your Payhip login credentials confidential.
- Account sharing/resale is not permitted unless we explicitly offer a multi-user plan.
- We may ask Payhip to suspend or restrict your access if we reasonably believe there is misuse (e.g., sharing, fraud, scraping, or attempts to extract content).
6) Lifetime access and delivery
- Access is provided immediately after successful payment via Payhip (or within a short technical processing time), by email link and/or through your Payhip account.
- You receive lifetime access starting on the day access is first granted. “Lifetime access” means access for as long as we offer and operate the guide (the lifetime of the Service), not unlimited access in time. It is not a guarantee that the Service will be available indefinitely: access may end or be restricted if we discontinue the Service or cease business operations, if we become insolvent or bankrupt or are otherwise unable to continue operating, or if our delivery partner Payhip discontinues or restricts the Service. In these cases we will, where legally permitted and reasonably feasible, give notice in advance and try to provide an alternative way to access or download the guide. Mandatory statutory rights remain unaffected.
- There is no fixed expiration date. However, access may end if you delete your Payhip account, if we terminate/suspend access for a breach of these Terms, or if we discontinue the Service or our use of Payhip (in which case we will provide reasonable notice and, where feasible, an alternative way to access the guide).
7) Prices, taxes, and payment
- Prices shown at checkout are final prices.
- Where we are required to charge VAT/sales tax, it is included in the final price shown.
- Checkout is provided by Payhip. Payments are processed via our own PayPal and/or Stripe account connected to Payhip (depending on your selection at checkout); the payment is made directly to us and Payhip does not hold your funds.
- For consumers located in the EU, the United Kingdom, the United States, or Canada, Payhip acts as reseller/marketplace facilitator (as applicable) and is responsible for calculating, collecting, and remitting the applicable VAT/sales tax on this digital content on our behalf. The VAT/sales tax shown at checkout is included in the final price. For customers in other countries, we remain responsible for any applicable taxes.
- Any currency conversion or extra fees charged by your bank/payment provider are your responsibility.
8) Immediate access consent (checkbox)
Because we provide access immediately, you must confirm a checkbox at checkout:
I expressly consent to immediate access to the digital guide before the withdrawal period ends, and I acknowledge that I will lose my right of withdrawal once access begins.
9) Cancellations, refunds, and statutory rights
- No change-of-mind cancellation once access begins. Since access is provided immediately after purchase, we do not offer voluntary cancellations or refunds for change of mind once access has started, except where required by applicable law.
- EU/EEA/UK consumers: If you have a statutory right of withdrawal, by requesting immediate access you expressly consent to immediate supply/performance and acknowledge that your statutory right of withdrawal may be lost once access begins, as permitted by applicable law.
- Mandatory rights remain: Nothing in these Terms limits any rights that cannot be excluded under applicable law (for example, rights if the digital content is defective or not as described).
- Details on how to request a withdrawal/refund (where applicable) are described in our Refund & Withdrawal Policy.
- Because payment is made directly to our own PayPal/Stripe account, any approved refund is issued by us directly through that account. Payhip does not hold funds and cannot issue refunds on our behalf.
10) License and strict use restrictions
We grant you a personal, non-exclusive, non-transferable, limited license to access and use the guide for your own personal use while your access remains active (see Section 6), subject to these Terms.
Not permitted: You may not (and may not allow others to) print, copy, paste, download, distribute, share, publish, republish, sell, resell, translate for resale, or otherwise extract the content (in whole or in part).
You may not use any manual or automated means (including bots, scrapers, browser extensions, scripts, or AI tools) to capture or extract content from the Service.
You may not remove copyright notices or bypass technical protection measures.
11) Intellectual property
All content, trademarks, and materials in the Service are owned by or licensed to Buziness Digital. Except for the limited license in Section 10, no rights are granted to you.
12) Availability and updates
We aim to keep the Service available, but interruptions can occur (maintenance, security, technical issues). We may update, change, or discontinue parts of the Service and content over time.
13) Acceptable use
You must not use the Service to:
- violate any law or third-party rights,
- attempt unauthorized access or disrupt the Service,
- distribute malware,
- bypass access controls, or
- perform any restricted actions listed in Section 10.
14) Suspension and termination
- We may suspend or terminate access if you materially breach these Terms (including account sharing, fraud, or attempts to extract/distribute content).
- If access is terminated due to your breach, refunds are not provided unless required by law.
- We may use reasonable measures to detect misuse (e.g., unusual login patterns or excessive automated requests).
15) Disclaimer (information only)
The guide is provided for general informational purposes. You are responsible for how you use the information. We do not provide professional advice unless explicitly stated.
16) Limitation of liability
To the maximum extent permitted by law:
- We are not liable for indirect or consequential damages (e.g., loss of profit, loss of data).
- Our total liability for any claim related to the Service is limited to the amount you paid for the Service giving rise to the claim.
- Nothing in these Terms limits liability where the law does not allow it (e.g., intent, gross negligence, or mandatory consumer protections).
17) Changes to these Terms
We may update these Terms from time to time. The “Last updated” date will change. If changes are material, we will provide reasonable notice via the Service or email where appropriate.
18) Governing law
These Terms are governed by German law. If you are a consumer, mandatory consumer protection rules in your country may still apply.
19) Language
We may provide translations. If there is any conflict between versions, the English version prevails.
